Why every Texan needs an estate plan — and how to get one without leaving your house

Most people put off estate planning because it feels complicated, morbid, or like something they will get to "eventually." I understand that. But here is what I tell my clients: estate planning isn’t about dying. It is about making sure that the people you love are never left guessing what you wanted.

What Estate Planning Actually Covers

A solid estate plan has three core components, and most people need all three.

Your Will. A Last Will and Testament directs where your assets go and, if you have minor children, who will care for them. Without one, Texas law decides — and it may not reflect your wishes. A will does not have to be complex to be effective. It just has to exist.

A Power of Attorney. A Durable Power of Attorney designates someone to manage your financial and legal affairs if you become incapacitated. This is not a document for old age. Accidents happen at any age. Without a POA, your family may have to go to court just to access your bank account or pay your bills.

A Healthcare Directive. Also called a Medical Power of Attorney or Directive to Physicians in Texas, this document tells your medical team — and the person you trust — exactly what kind of care you want if you cannot speak for yourself. It removes the burden of a nearly impossible decision from your loved ones at the worst possible moment.
